Habeas Corpus and the War on Terror
Habeas Corpus and the War on Terror Ian T. Snyder POL 201 Pearl Galano October 20th 2012 Habeas corpus is considered to be one of the most fundamental guarantees of personal liberty we have enjoyed as a country since the inception of our Constitution. However, questions have arisen regarding the proper use of habeas corpus and have been brought into focus in the past decade. In the years since the September 11, 2001 terrorist attacks, hundreds of people have been detained by the United States government as part of its war on terror. Most of these detainees face indefinite detention and have neither been charged with a crime nor afforded prisoner of war status. Habeas corpus serves to protect citizens against arbitrary arrest, torture, and extrajudicial killings and is a fundamental personal liberty guaranteed by our Constitution and cannot be suspended based on that fact.Habeas corpus (or writ of Habeas corpus ) is a judicially enforceable order issued by a court of law to a prison of ficial ordering that a prisoner be brought to the court so it can be determined whether or not that prisoner had been lawfully imprisoned and, if not, whether he or she should be released from custody. The right of habeas corpus is the constitutionally bestowed right of a person to present evidence before a court that he or she has been wrongly imprisoned. The rights of writs of habeas corpus are granted in Article I of the Constitution, which States, ââ¬Å"The Privilege of the Writ of Habeas Corpus shall not be suspended, unless when in Cases of Rebellion or Invasion the public Safety may require it. ââ¬Å"( Habeas Corpus in times of Emergency; Iowa State Review) A Habeas Corpus petition is a petition filed with a court by a person who objects to his own or another's imprisonment. The petition must show that the court ordering the imprisonment made a legal or factual error. The right of habeas corpus is the constitutionally bestowed right of a person to present evidence before a co urt that he or she has been wrongly imprisoned. History The history of Habeas Corpus is ancient. It appears to be predominately of Anglo-Saxon common law origin, although the precise origin of Habeas Corpus is uncertain. Its principle effect was achieved in the middle ages by use of similar laws, the sum of which helped to mold our current policies. Habeas Corpus has since the earliest times been employed to compel the appearance of a person who is in custody to be brought before a court.Habeas Corpus was generally unknown to the various law systems of Europe which are generally devolved from Roman law. European civil law systems tend to favor collective authority from the top down while the Anglo-Saxon common law tends to favor the individual. As a feature of common law, the right of Habeas Corpus reflects the age old contest between the individual and the state. Habeas Corpus empowers the individual in holding accountable the exercise of the states power to influence liberty. The War on TerrorIn the years since the September 11, 2001 terrorist attacks, hundreds of people have been detained by the United States government as part of its war on terror at locations such as the Guantanamo Bay Naval Base in Cuba and Bagram Airfield in Afghanistan. Most of these detainees have faced indefinite detention and have neither been charged with a crime nor afforded prisoner of war Status. Many of these detainees have sought to use habeas corpus proceedings to challenge the legality of their detention. The United States government initially took the position that habeas corpus was not available to detainees because of their status as ââ¬Å"enemy combatantsâ⬠and their location outside of the sovereign territory of the United States. In 2004, the United States Supreme Court determined that non-citizen detainees at Guantanamo Bay were entitled to file habeas corpus petitions in federal courts. Congress subsequently made a political determination as to the appropriate s cope of habeas corpus and passed legislation that, stripped federal courts of jurisdiction to hear habeas corpus petitions brought by enemy combatants. This ruling was then shortly overturned. The question of whether detainees such as those at Bagram and Guantanamo Bay should have access to habeas corpus is a complex one. It involves issues of territorial jurisdiction, separation of powers, and the status of the individuals. However, at a more basic level, this question should ask as to the nature of the right of habeas corpus and the applicability of the rule of law during national security emergencies. At this level, the situation presented by detainees at Guantanamo Bay or Bagram is not entirely unique. It represents another example of those situations in which governments have attempted to deny the availability of habeas corpus based on real or perceived threats to national security. On Oct. 17, 2006, President Bush signed a law suspending the right of habeas corpus to persons â⠬Å"determined by the United Statesâ⬠to be an ââ¬Å"enemy combatantâ⬠in the Global War on Terror. President Bush's action drew severe criticism, mainly for the law's failure to specifically designate who in the United States will determine who is and who is not an enemy combatant. This however was not the first time in the history of the U. S. Constitution that itââ¬â¢s guaranteed right to habeas corpus has been suspended by an action of the President of the United States. In the early days of the U. S. Civil War Abraham Lincoln suspended writs of habeas corpus. Both presidents based their action on the dangers of war, and both presidents faced sharp criticism for carrying out what many believed to be an attack on the Constitution. President Bush suspended writs of habeas corpus through his support and signing into law of the Military Commissions Act of 2006.The bill grants the President of the United States almost unlimited authority in establishing and conducting mi litary commissions to try persons held by the U. S. in the Global War on Terrorism. In addition, the Act suspends the right of ââ¬Å"unlawful enemy combatantsâ⬠to present, or to have presented in their behalf, writs of habeas corpus. 1. Jonathan Turley, professor of constitutional law at George Washington University stated, ââ¬Å"What, really, a time of shame this is for the American system. What the Congress did and what the president signed today essentially revokes over 200 years of American principles and values. â⬠To which I agree. The Presidentââ¬â¢s decision to deny the detainees prisoner-of-war (POW) status remains a point of contention, especially overseas with some arguing that it is based on an inaccurate interpretation of the Geneva Convention for the Treatment of Prisoners of War , which they assert requires that all combatants captured on the battlefield are entitled to be treated as POWs until an independent tribunal has determined otherwise. The Genev a Conventions of 1949 create comprehensive legal specifications for the treatment of detainees in war. Members of a regular armed force and certain others share entitled to specific privileges as POWs.Members of volunteer corps, militias, and organized resistance forces that are not part of the armed services of a party to the conflict are entitled to POW status if they meet four criteria specified in the treaty. Groups that do not meet the standards are not entitled to POW status, and their members who commit belligerent acts may be treated as civilians under the Geneva Convention Relative to the Protection of Civilian Persons in Time of War. ( Terrorism, the Laws of War, and the Constitution ââ¬â Policy Archive ) These ââ¬Å"unlawful combatantsâ⬠are not afforded immunity for their hostile acts.A petitioner must be treated as a prisoner of war until a competent tribunal has decided otherwise, and that a military commission may not proceed with their trial. Although some 250 detainees (including three children under the age of 16)13 have been released from the detention facilities at the U. S. Naval Station in Guantanamo Bay, Cuba, and some detainees are being rewarded for cooperation with better living conditions while the status and treatment of detainees who remain in custody continue to be a source of contention. (ââ¬Å"Enemy Combatantsâ⬠Journal, Wuerth) SummaryThe Constitution provides Congress with ample authority to legislate the treatment of battlefield detainees in the custody of the U. S. military. The Constitution empowers Congress to make rules regarding capture and to define and punish violations of international law, and to make regulations to govern the armed forces. (Policy Archive) Congress also has the constitutional prerogative to declare war, a power it has not yet exercised with regard to the armed conflict in Afghanistan. By not declaring war, Congress has implicitly redefined what was clearly stated in the Constitution concerning the treatment of detainees. The Administration has asserted that the war on terror is a new kind of conflict, requiring a new set of rules and definitions. However it is clear that there has been a failure to expeditiously process and, if appropriate, prosecute detainees in the custody of the United States, including those in the custody of the United States. Financial Analysis of Yum Brands
A Financial Analysis of Yum! Brands, Inc Restaurants are, and will continue to be, an extremely profitable business. As a result, shareholders who have interest in brands such as McDonalds and Starbucks need not to worry about negative implications for the food giants compared to more risky industries. One company in particular, Yum! Brands (YUM), is another brand investors should become familiar with. Consumers may recognize the more specific stores the company owns such as Taco Bell and Pizza Hut, but investors should realize the sales and earnings growth associated with this organization. In addition, while there are many companies in the restaurant industry, Yum not only rings familiar with consumers like Starbucks, but Yum engenders excellent financial news at a level above its competitors. However, before trying to access these financial statements, it is important to understand more specifics about Yum's business model. According to Reuters, Yum ââ¬Å"is a quick service restau rant (QSR) with over 34,000 units in more than 100 countries and territories. â⬠These quick service restaurants include consumer favorites such as Taco Bell, Pizza Hut, Long John Silver's, and KFC.Whether the operating segment sells pizza or chicken, ââ¬Å"Yum develops, operates, franchises and licenses a worldwide system of restaurants, which prepare, package and sell a menu of food items. â⬠As each of these fast-food places is obvious to most readers in America, it is also quite interesting that over 100 countries are familiar with these names as well. In fact, segments like KFC were actually introduced in many markets like China before more obvious competitors like McDonalds. Since fast food is generally considered an inelastic, or non-cyclical, good, even during times of economic uncertainty, Yum will prosper. While most of its food is relatively cheap compared to rivals such as Brinker and Darden, consumers will still flock to Yum restaurants in similar volume durin g any stage of the economic cycle. Therefore, revenue growth should continue to remain steady, but positive, year after year making Yum a great portfolio choice at any time. To justify this claim, during the past twelve months, Yum received a revenue figure, according to Reuters, of $9. 56 billion. This number was a 5. 05% increase compared to the previous year number. While this increase in margin was a bit below the average year-to-year increase of 6. 58%, the difference in growth decline was only a 23% difference. Other companies like Brinker saw a 43% deceleration during this same time period. In addition, while some investors may critique the industry 11. 31% growth in sales during the past to Yum's lower numbers, it is also important to realize that Yum supports the seconds highest sales figure in its industry, and appreciation of revenue growth will be much difficult than smaller-capitalization companies to come-by.This is in addition to the fact that many lower-revenue compan ies in this industry are actually seeing negative sales growth (not deceleration) during the same time frame as the aforementioned analysis. With these thoughts on sales at hand, these numbers can be used at the broadest of levels to illustrate that the steady increase and influx of money into Yum over its career has aided in the appreciation of its share price. Since 2003, not once has Yum seen a calendar year decrease in price. This comes with a 25% appreciation in 2006 and a 12% escalation so far in 2007ââ¬âdespite the recent economic turmoil. These sales and share price indications illustrate that Yum will fair very well during all types of economic activity. Nevertheless, revenue cannot be the only financial analysis required to find superior companies. It is vital to understand how efficient a company is in reducing costs and using capital and labor to actually produce the final good. These intangible-sounding comparisons can actually become tangible given the use of margin s. Starting from gross margins, investors should be happy to find out that over the past twelve months, growth at 25. 9% has been higher than the pervious five year average of 24. 82%. While the former is a bit below the industry's average of 29. 04%, it is important to stress that Yum's revenue is the second highest in a fairly large industry, making outstanding margins difficult to come by. Nevertheless, compared to close revenue competitors, Yum's gross margins are better than Starbucks's (23. 62%), Darden's (23. 50%), and Brinker's (16. 42%). In addition, Yum's operating margins of 13. 14% are not only higher than its five year average of 12. 84%, but is doing better than the industry's twelve month margin of only 11. 76%.Moreover, these operating figures for Yum are also better than the same-time period numbers of Starbucks (11. 18%), Darden (9. 53%), and Brinker (7. 87%). While these numbers all indicate growth for Yum, the biggest instrument (that will be justified later with valuation tactics) is earnings differences. Fortunately for Yum, a 16. 27% increase in earnings per share over the past year is 29. 74% higher that the company's five year average increase. Compared to competitors, all three of Brinker, Darden, and Starbucks saw a deceleration of earnings growth last year, and none of these yearly increases matched the top-revenue producer, Yum.While there is clear evidence that Yum is great growth story, some investors may wonder whether Yum is overvalued given its success. Fortunately for these investors, this is not the case. In fact, some potential shareholders may make the claim that Yum is undervalued. Currently the industry has a P/E multiple of 31. 88 and a price to sales ratio of 2. 10. However, if analyst expectations are correct or and underestimate actual results (5/5 and 4/5 correct or below last five quarters for EPS and sales respectively), Yum sees a forward price to sales ratio 1. 9 and price to earnings ratio of 20. 18. Now while these numbers are not extraordinarily undervalued, as companies like Darden have slightly lower figures, compared to the industry as a whole and competitors like Starbucks (2. 25 price to sales and 31. 48 price to earnings), Yum's valuation is far from being labeled as a negative characteristic. Therefore, given good growth reports and not too much speculation relative to share price, there is strong news from both further financial achievement and valuation. However, before reaching a final conclusion, there are some other indicators to look at. One of these criteria is management efficiency. According to Reuters, Yum had seen a 60. 80% ROE figure for the past twelve months. While a bit smaller than the five year average, the number easily obliterates the industrial average and all three aforementioned market-cap competitors. This figure illustrates that Yum is not only increasing its net profit year after year, but helping investors by purchasing back some of its stock. Although ca pital spending is a bit below industrial averages at -0. 0% over the past five years for Yum, the company still has a healthy balance sheet of cash, especially compared to its price (undervalued). In addition, efficiency also comes from the company's turnover ratios. Receivable turnover at 41. 62%, inventory turnover at 80. 93%, and asset turnover at 1. 61% are all quite above the industrial averages and many competitor averages as well. Solvency with a current ratio of 0. 59 is quite low, but inline relative to the rest of the industry, but fast food restaurants need not to worry too much about liquidating assets. In addition, 83. 13% of equity for Yum is owned by institutional investors. This number is above the industrial figure at 74. 07% and also above Darden's and Starbuck's respective numbers. While there are many intelligent retail investors, having the real experts in institutional investors carry the bulk of the company shows optimism for future performance. And in addition al to this control, another enticement in a 1. 81% dividend yield should also help investors relay this company into more hands at a higher share price.Looking at the business model and fundamental features, there is strong evidence to support that investing in this company will yield strong returns. Technically speaking, the share price of Yum just recently crossed both the 50 day SMA and EMAââ¬âa bullish signal, and while there is encouragement to invest any time to profit from this company, now would be an almost ideal situation. Therefore, with the above information provided to benefit long term investors, it is closely assured that investing in YUM! Brands will produce genteel capital gains for shareholders. Marketing Simulation Essay
The rest of the sales force time would be equally divided between the segments B, C and D. Change in Strategy: During simulation, we studied the effects of percentage increase of sales force time for each market segment individually along with decrease in list price. As we proceeded with the simulation, we found that * A decrease in list price and an increase in percentage sales force time for segment D would be more fruitful in the short run as it will increase the overall sales volume and overall profit much more than in the case where sales force concentrates more on segment A. This is because the overall market share of highly price sensitive customers in segment D and ââ¬Å"small volume customersâ⬠is almost three times of segment Aââ¬â¢s market share. * So, even though the profit margin in segment D and ââ¬Å"small volume customersâ⬠is lesser than that for segment A, the overall profit was greater because of the scope of much higher sales volume. * Hence, we dec ided to increase the sales force percentage time for segment D to 40% and for segment A to 30%. We decreased the sales force time percentage for segments B and C to 15% each. Also, we reduced the list price from $142 to $136. Challenges during simulation: During simulation, the primary challenge we faced was to decide on the key parameters that should be changed and the level of change in each of these parameters to get optimum profit and higher market share. Key decisions: Since our initial strategy was to increase the sales volume of segment A, we decided to concentrate on sales force time percentage parameter for each segment and the list price of the motors. We studied the effects of percentage increase of sales force time for each market segment individually along with decrease in list price on the overall profit of the company. Solution Analysis Decrease in list price from $142 to $136 and increase in sales force time percentage to 40% for segment D and to 30% for segment A. * Segments B and C sales force time was reduced because of the high competition that MM faces in these categories on the basis of the rmal resistance parameter. Hence, in the long run, MM can target for higher profit margins than for higher sales volume if it concentrates the sales and market research resources to segments A, B and C. The main challenge with this approach is that it would difficult to attract customers from these segments who are already loyal to competitors and would require much more effort from the sales team and the product development team to come up with a product that caters the needs of these segments especially segments B and C where MM has yet to prove its overall competitiveness. Learning and experience This simulation exercise helped us to validate whether our suggested solution was an optimal one and also helped us to arrive at new solutions through experimentation which finally led to change in our overall decisions and strategy. It also showed us how varying a single parameter can change the overall market share and overall profits of the company. Finally, it reinforced the theory behind segmentation of customers according to their buying behavior to achieve optimal marketing strategies.

Principle Terrestrial Biomes Annotated Bibliography
Principle Terrestrial Biomes - Annotated Bibliography Example One of the strength of the motivating programs is that itsââ¬â¢ automation makes it easier to identify individual merits and reward them accordingly. Compliments and other recognitions should be posted there to motivate them. Communication with employees from wherever they are makes them feel part of the company as they feel more appreciated and derive a sense of belongingness. This should continue being exploited at all times. Some weaknesses have also been noted in the discussion section. One of these entails shortcomings in communication. Employees should be made part of the decision-making team to ensure they feel obligated to work for a hospital. A hospital should also outsource some required services especially in recruitment programs to allow them cope with the challenges fostered by motivation programs. Abstract - The study recognizes that the concept of design has an effect on a patient's healing process. In the study, substantial evidence presents that the design of medi cal institutes influence the health outcomes of patients, as well as recruitment and retention of the hospital staff. In addition, the concept of design also affects the efficiency of how care is being provisioned. In United Kingdom, primary health and social care is being prioritized due to the ageing population of the country. Summary - The purpose of the study is to incorporate an environment that would deliver safety, efficiency and quality that is flexible to changing delivery patterns in the provision of care. ... This article focuses on the temperate grasslands, and examines and populations in them. It looks at a natural experiment occurring in a small region of Germany, where an area of grassland is persistently expanding by removing other obstacles to it such as human habitation. The exact dates that these obstacles were removed is well known, so know exactly how old the grasslands are, which is rare when studying ecological succession. They use this knowledge to examine the different species of ant which colonize the grassland once the grassland begins to grow. It uses simple sampling techniques to examine the populations of a wide variety of different types of ants at different stages of grasslands development, and the techniques used and data collected both seem extremely reliable. The research team found that in younger grasslands, there were a wide variety of different species that changed from individual patch of grassland to individual patch of grassland, because the initial populati ons were mostly dependent on the random chance of an individual or group from that species wandering into the grassland accidentally. They found, however, that as the grasslands matured and when studying older grasslands this initial diversity and wide range of species disappears, to be replaced with a more predictable group of species. This suggests that the initial distribution of species has no impact on the eventual one, and that a number of highly successful species of ants will consistently outperform other species in this kind of grassland. Benefits and Drawbacks of Studying at University Essay
Benefits and Drawbacks of Studying at University - Essay Example Most of the employed graduates have shown to have medical insurance covered by their subsequent employees. University graduates are perceived to engage in a healthy lifestyle, then the high school counterparts. According to the statistics, the level of health increases with higher education. For instance, statistics shows that more than 70 percent of university graduates with income between $35,000 and $54,000 are in better health condition than those high school graduates in the same income bracket and age. Also among the graduates, the level of heath increases with the level of degree attained. The incarceration rate has been seen to be higher in adults with high school education than those with university or college education. Increase in incarceration rate increases the amount government spends on prison costs per an individual inmate. Though this takes us back to the economic benefits of higher education, this finding is more tagged to the effects on the society. Statistics confi rm that, in 1997, 1.2 percent of those incarcerated were adults with no graduate education, but only 0.1 percent of them had higher education. This shows that increased level of university education tends to decrease the potential and characteristics to get involved in crime. Academic success is also viewed as a factor that reduces the likelihood to commit crimes (Cunningham, 2008, p. 1). These children are able to take more education task s and are more informed than those of mothers with lower education background. This means that attainment of higher education will bring forth future benefits of a more informed and learned society. According to research children between the age of 3-5, more than 36 per cent among them whose mother had university education could recite all letters of the alphabet, compared to less than 19 percent of those of high school graduate mothers (Hill, 2005, p. 1.). Ninety per cent of children from graduatesââ¬â¢ mother read to not less than 3 times per week, in comparison with the 76 percent of those with high school mothers. Critique of Selected Epidemiological Research Article Paper - 1
Critique of Selected Epidemiological Article - Research Paper Example The study reports a hypothesis that the visits that are undertaken for the older age in the cardiovascular study is related to main demographic, lifestyle, health and function participant traits and that the oldest age would have the poorest retention for in-person visits, particularly clinic visits. The hypothesis of the study is directional as it has taken a stand on the subject matter which is yet to be determined. However, it is a complex one since the measurement methods would not be easy in terms of tool applications. It also requires the application of more than one tool for its determination. It was tested using the face to face interviews, phone interviews, as well as personal visits. This was also done through sampling from Medicare eligibility lists, non-institutionalized, ambulatory men and women aged 65 and above. During the study, men and women of age 65 and older got enrolled including the 5201 at 4 US field centers. These formed a mean enrollment age of 73 years with a range of 65-100 forming 58%, 16 % being black. The first phase took place in 1989 to 1990 with the addition of 687 African-American participants in the year 1992 to 93. The participants were taken through an extensive baseline evaluation. This included the laboratory assessments, physical and cognitive functioning and medical history. All these components were repeated at the annual clinic visits through 1998 to 1999. The total population of the study of surviving participants throughout the time was, N=43,772. By the year 2005-06, the entire population was re-recruited in order to reevaluate physical and cognitive functioning and reassess functional status. In this case, the median age was 85 while the range was 77-102 of which 67% were women, and 17% were black (Strotmeyer, et al., 2010). The study in this case was quasi-experimental since it involved the determination of the

Alternate Energy Engineering - Turbine Blades Research Paper
Alternate Energy Engineering - Turbine Blades - Research Paper Example Both the types of wind turbines have the different orientation of blades. For three blade design of either VAWT or HAWT, there is a 120o angular difference between the blades. For two blade design, the angular difference between the blades is 180o and for four-blade design, the angular difference between the blades is 90o. Importance of turbine bladesTurbine blades are the most important part of the wind turbine. Conventionally turbine blades are manufactured with tensile metals which are then reinforced with ceramics, other metals, fiberglass or then some materials to enhance the durability of the blades and reduce the metallic characteristics of fatigue, rupture, and corrosion (Quarton, 6). Turbine blades collect the kinetic energy of wind and transform it into mechanical energy by reacting against the kinetic energy of the wind. The energy transferred from the wind is directly proportional to the speed of the wind. On the other hand, the reacting surface area of the wind turbine b lades also matters a lot. On the other hand, it is important to design the turbine blades in the manner that they produce no hurdle in transferring energy from the wind to the rotor. A wind turbine may have multiple turbine blades but wind turbine should have at least two turbine blades that should be properly balanced with respect to each other and with respect to the rotor of the wind turbine. Any imperfection in the wind turbine blades results in effective power loss and rupturing with continuous use.
